Welcome to Back My Bracket. By accessing or using the Back My Bracket mobile application, website, or any related services (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). Please read them carefully.

If you do not agree to these Terms, do not use the Service.

1. Eligibility

You must be at least 18 years of age to use the Service. By using the Service, you represent and warrant that:

• You are at least 18 years old
• You have the legal capacity to enter into a binding agreement
• You are not prohibited from using the Service under applicable law
• The information you provide is accurate and complete

2. Account Registration

To use certain features of the Service, you must create an account. You agree to:

• Provide accurate and complete registration information
• Maintain the security of your password and account credentials
• Notify us immediately of any unauthorized account access
• Take responsibility for all activity occurring under your account
• Not create more than one account per person

We reserve the right to suspend or terminate accounts that violate these Terms.

Back My Bracket uses a virtual credits system ("BMB Credits") for platform participation. You acknowledge that:

• BMB Credits are virtual currency with no cash value unless specifically redeemable through the platform's gift card or payout features
• Credits may be earned through bracket participation, referrals, and promotional activities
• Credits may be purchased using real currency through the in-app store
• Purchased credits are non-refundable except as required by applicable law
• We reserve the right to modify the credits system at any time with notice
• Credits expire if an account is inactive for 12 consecutive months

5. Bracket Contests and Picks

By participating in bracket contests, you agree that:

• All bracket picks are final once submitted
• Contest results are determined by real-world sports outcomes
• We reserve the right to cancel or modify contests due to unforeseen circumstances
• In the event of a contest cancellation, any entry credits will be refunded
• Disputes regarding contest results must be submitted within 48 hours of the result being posted

6. Prohibited Conduct

You agree not to:

• Use the Service for any unlawful purpose
• Create multiple accounts to gain unfair advantages
• Use automated bots, scripts, or software to interact with the Service
• Attempt to circumvent security measures or access unauthorized areas
• Harass, abuse, or harm other users
• Upload malicious code or interfere with Service operations
• Misrepresent your identity or affiliation
• Engage in any form of fraud or manipulation of contest results

7. Payments and Refunds

Payment processing is handled by Stripe, Inc. By making a purchase, you agree to Stripe's terms of service. Regarding refunds:

• Credit purchases are generally non-refundable
• Refund requests due to technical errors will be reviewed case-by-case
• Contact support@backmybracket.com within 7 days of a transaction for refund consideration
• Chargebacks initiated without contacting us first may result in account suspension

8. Intellectual Property

All content within the Service, including but not limited to logos, graphics, text, and software, is the property of Back My Bracket and is protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works without our express written permission.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, BACK MY BRACKET SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Our total liability to you for any claim arising from the Service shall not exceed the amount you paid us in the 90 days preceding the claim.

11. Indemnification

You agree to indemnify, defend, and hold harmless Back My Bracket and its officers, directors, employees, and agents from any claims, liabilities, damages, and expenses (including attorneys' fees) arising from your use of the Service, violation of these Terms, or infringement of any third-party rights.

12. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of [Your State], without regard to conflict of law principles. Any disputes arising from these Terms or the Service shall be resolved through binding arbitration in accordance with the American Arbitration Association rules, except that either party may seek injunctive relief in a court of competent jurisdiction.

We may suspend or terminate your account and access to the Service at our discretion, with or without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties. Upon termination, unused purchased credits may be forfeited.
